Last updated: 14 October 2026
These Terms of Use ("Terms") govern your use of https://smoke-machine.com (the "Site"). The Site is operated by X Enterprises, LLC, 18122 3rd Dr SE, Bothell, WA 98012 ("we," "us," or "our"). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.
What the Site is, and what it is not
The Site publishes general information about fog, haze, and smoke machines: how they work, fluids, smoke alarms, venues, setup, cleaning, and control. We are not a retailer, a brand, a machine maker, a fluid maker, a special effects company, or a venue. We do not sell machines, fluids, dry ice, or any other product, and we do not provide technical support for any device.
Important safety notice
Fog, haze, and smoke effects carry real risks. Machines and nozzles get very hot. Dry ice can cause severe frostbite, and the carbon dioxide gas it gives off can build up in low or enclosed spaces and cause suffocation. Fog and haze can reduce visibility, hide exits and signs, leave slippery residue, and set off smoke alarms. Some people may find fog irritating to breathe. You are responsible for deciding whether to use any effect, and for following the maker's manual, the label and safety data sheet of any fluid, the venue's or building's rules, and the law where you are. If you are not sure an effect can be used safely in a space, do not use it.
General information only; no professional, safety, or health advice
Content on the Site is for general information. It is not professional, engineering, fire safety, occupational safety, medical, health, or legal advice, and it is not a substitute for the maker's manual, a venue's rules, a fire authority, or a doctor. We do not make health or safety claims about any machine, fluid, or effect, and we do not say that any fluid or effect is safe, non-toxic, or harmless. Anyone with asthma, another breathing condition, or other health concerns should ask a doctor before being around fog, haze, or dry ice effects.
Fog fluids, dry ice, and carbon dioxide
Use only the fluid your machine's maker names, and follow its label and safety data sheet. We do not publish fluid recipes. Dry ice and carbon dioxide are hazardous: never handle dry ice with bare hands, never put it in a sealed container, use it only where there is good ventilation, keep it away from children and pets, and keep people out of low or enclosed spaces where carbon dioxide can gather. The Site does not give instructions for making dry ice or low-lying effects. Guidance we cite, such as UK Health and Safety Executive (HSE) and U.S. government pages, belongs to its publisher; HSE guidance is written for UK workplaces and is cited for general information only.
Smoke alarms and fire safety
Fog and haze may set off smoke alarms. Never disable, cover, unplug, or remove a smoke alarm, or remove its battery, to use an effect. Plan any effect with whoever manages the alarm system. Nothing on the Site tells you how to avoid, bypass, or silence an alarm. Keep exits, exit signs, and paths clear and visible. Keep hot machines away from anything that can burn.
Venues, buildings, and local rules
Venues, landlords, building managers, and local fire authorities set their own rules for fog, haze, dry ice, and other effects, and some do not allow them. Ask before you use any effect, and follow their answer. Where the Site lists questions to ask a venue, the list is a starting point, not a complete safety plan.
Lasers, pyrotechnics, and other effects
The Site does not cover lasers, pyrotechnics, or flame effects. They have their own safety rules. Ask the venue and a qualified operator.
Machine makers and their manuals
Machines and fluids are made and sold by third parties under their own terms. Steps and figures on the Site that come from a maker's manual or warning sheet are that company's guidance for its own model, credited to it; we have not tested them, they may not apply to your machine, and they may change. Your machine's manual controls. We are not responsible for any third party's machines, fluids, or instructions.
Brand names and trademarks
Brand, product, and standard names mentioned on the Site belong to their owners. We use them only to credit their own manuals, guidance, or standards. The Site is not affiliated with, sponsored by, or endorsed by any brand or organization it mentions.
Affiliate links
Some links may be affiliate links. We may earn a commission if you buy through them, at no extra cost to you. Any purchase is between you and the retailer, under the retailer's terms. See our Affiliate Disclosure.
Eligibility
The Site is for a general audience. It is not directed to children under 13.
Acceptable use
You agree not to:
- use the Site in violation of any law;
- copy, scrape, or republish Site content in bulk without our written permission;
- interfere with, overload, or attempt to gain unauthorized access to the Site.
Intellectual property
Site content, design, and text are owned by us or our licensors and are protected by law. You may view and share links to the Site for personal, non-commercial use. Third-party names and trademarks are covered under "Brand names and trademarks" above.
Third-party websites
Links to retailers, makers, standards bodies, government agencies, and other websites are provided for convenience. We do not control those sites and are not responsible for their content, products, prices, or policies.
Disclaimer of warranties
THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE ANY PURCHASE FROM A THIRD PARTY, OR YOUR USE OF ANY MACHINE, FLUID, DRY ICE, OR EFFECT. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT LAWFULLY BE LIMITED.
Indemnification
You will defend, indemnify, and hold us harmless from claims, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the Site or your violation of these Terms.
Dispute resolution; binding arbitration; class-action waiver
Please read this section carefully. Except for small-claims matters and claims for injunctive relief over intellectual property, any dispute about these Terms or the Site will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The seat of arbitration will be King County, Washington, unless you and we agree otherwise. You and we waive any right to a jury trial and to take part in a class, consolidated, or representative action. If the class-action waiver is found unenforceable for a claim, that claim must proceed in court and not in arbitration.
Governing law and venue
These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law rules. Subject to the arbitration section, exclusive venue for permitted court actions is the state or federal courts in King County, Washington, and you consent to jurisdiction there.
Assignment and change of operator
We may assign or transfer these Terms, and the Site, to a successor operator, including as part of a sale of the Site, without notice to you. After that, the successor operator takes our place under these Terms and may post its own terms. You may not assign these Terms without our written consent.
Changes
We may update these Terms by posting a revised version on this page with a new "Last updated" date. Continued use after that date means you accept the revised Terms.
Miscellaneous
These Terms, with the Privacy Policy and Affiliate Disclosure, are the entire agreement between you and us about the Site. If any provision is unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver.
